The Concept of Prevention Against The Criminal Act of Forgery of Signatures By Customers or Agents at Insurance Companies In Indonesia

Abstract
Penelitian ini merupakan penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan, pendekatan konseptual, serta pendekatan kasus. Data yang digunakan terdiri atas bahan hukum primer berupa peraturan perundang- undangan terkait asuransi dan tindak pidana pemalsuan, serta bahan hukum sekunder berupa literatur, jurnal, dan hasil penelitian terdahulu. Analisis dilakukan secara kualitatif dengan menitikberatkan pada sinkronisasi antara teori pencegahan kejahatan dan penerapan hukum positif di Indonesia.
Hasil penelitian menunjukkan bahwa pemalsuan tanda tangan pada industri asuransi terjadi karena lemahnya mekanisme verifikasi dokumen, kurangnya edukasi kepada agen maupun nasabah, serta adanya celah hukum dalam regulasi asuransi. Konsep pencegahan yang dapat diterapkan meliputi penguatan sistem autentikasi digital, peningkatan pengawasan internal, pelatihan etika dan kesadaran hukum bagi agen, serta harmonisasi regulasi agar selaras dengan perkembangan teknologi dan kebutuhan industri. Dengan demikian, penelitian ini memberikan kontribusi dalam perumusan langkah preventif yang dapat memperkuat integritas industri asuransi di Indonesia.
