The Antinomy of Final Legal Decisions and Administrative Settlement of Plantations in Forest Areas: A Case Study of PT Torus Ganda
##plugins.themes.academic_pro.article.main##
Abstract
This article aims to analyze the antinomy between final and binding court judgments and the settlement mechanism for plantation activities within forest areas under Articles 110A and 110B of Law Number 6 of 2023, using the PT Torus Ganda case. This normative legal study finds that the administrative mechanism may hinder the execution of court judgments and create legal uncertainty. Harmonization between judicial and administrative authority is therefore necessary to preserve legal certainty. The findings of this study indicate that final and binding court judgments must be positioned as norms that take priority in enforcement based on the principle of *res judicata pro veritate habetur*, the principle of legal certainty, and the guarantee of judicial independence as stipulated in Article 24 of the 1945 Constitution of the Republic of Indonesia. Therefore, Articles 110A and 110B cannot be interpreted as a legal basis to delay, reduce, or set aside the enforcement of court judgments that have obtained final and binding legal force. Accordingly, the administrative settlement mechanism within forest areas should only be applied to business activities that have not yet become the subject of a final and binding court judgment, thereby ensuring legal certainty, the effectiveness of forestry law enforcement, and the sustainable protection of forest areas.
