Legal Protection Of Consumer Personal Data In Electronic Transactions With Legal Certainty

Abstract
Jenis Penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Hasil penelitian ini, yaitu Regulasi terkait pelindungan data pribadi menurut peraturan perundang-undangan yang berlaku di Indonesia, diantaranya adalah: Peraturan Pemerintah Nomor 71 Tahun 2019 tentang Penyelenggaraan Sistem dan Transaksi Elektronik merupakan revisi dari Peraturan Pemerintah Nomor 82 Tahun 2012. Selain itu juga diatur dalam Peraturan Pemerintah No.44 Tahun 2008 tentang Pemberian Kompensasi, Restitusi, dan Bantuan Kepada Saksi Korban, selain itu adapun Pasal 1 ayat (6) dan Pasal 5 ayat (1) Poin A Undang-Undang tentang Perlindungan Saksi dan Korban, PERKOMINFO (Peraturan Menteri Komunikasi dan Informatika) Nomor 20 Tahun 2016 serta Pasal 28 ayat (1) Undang-Undang Nomor 1 Tahun 2024 tentang Perubahan Kedua Atas Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik.
Peraturan peraturan tersebut ditujukan kepada masyarakat untuk menghormati data pribadi yang menjadi bagian dari hak privasi agar data pribadi orang lain tidak tersebar luas ataupun diperjualbelikan dengan alasan apapun. Perlindungan hukum data pribadi konsumen atas transaksi elektronik yang berkepastian hukum adalah sebagaimana terdapat dalam Pasal 19 Undang-undang Perlindungan Konsumen bahwa startup e-commerce bertanggung jawab atas kerugian yang dialami konsumen dengan memberikan ganti rugi administratif bagi konsumen.
